The article analyzes Brad Smith’s, President of Microsoft, call for a “Digital Geneva Convention” to address the increasing problem of state-sponsored cyberattacks.

The article examines the current international legal framework for cyber operations, detailing how it addresses these attacks. It asserts that although a comprehensive international legal framework exists, States are unlikely to agree to a treaty that would limit their cyber operations.

The article concludes by suggesting that the tech sector could play a more constructive role in shaping international cyber law by developing a reputation as a trusted agent and engaging in the international law dialogue with a correct understanding of the state of the law.
